Commissioner Issues Final Pay-As-You-Drive Regulations
Commissioner Poizner issued today his final Pay-As-You-Drive automobile insurance rate regulations.В The final version reflects the changes we discussed in our August 4 blog post.В The primary changes in the regulations from their initial release, discussed also in our June 25 blog post, include prepaid miles options for drivers; an allowance for selling mileage verification policies in addition to estimation policies, or just verification policies; filing of the exact types of mileage verification that an insurer will accept; equal access to all mileage verification methods; and prohibition of the use of vehicle location data with the exception of entities such as motor clubs which may make available location devices for purposes of emergency road service, theft service, map service, or travel assistance.В The Office of Administrative Law now has thirty days to act on the regulations, after which insurers may apply to offer a pay-as-you-drive plan.
